apothem does not provide financial advice, no personalized investment recommendation and is not an investment service provider (ISP) approved by the Financial Markets Authority (AMF) or any other financial regulatory authority.
Apothem is a non-custodial, multi-tenant execution infrastructure. Each User connects their own TradingView strategy via a personal webhook with a unique passphrase. Apothem executes orders received on the Hyperliquid account of the User concerned only. Apothem does not distribute any common strategy and does not issue any trading signals to Users.

In France, capital gains on transfers of cryptocurrencies are subject to the Flat Tax (Single Flat Tax of 30%) or the progressive scale of income tax, depending on the User's options. apothem does not provide any tax documents and cannot be held responsible for the User's tax obligations.
API keys provided by the User are encrypted at rest with AES-256 (Fernet) encryption on apothem's servers. However, the User must:

The total and cumulative liability of apothem, for all causes combined, is expressly limited to the amount actually paid by the User for access to the Service during the last three (3) months preceding the event giving rise to the damage. This limitation applies to the fullest extent permitted by applicable law.
All elements constituting the apothem platform are the exclusive property of the Operator and are protected by intellectual property law, in particular:
The User benefits from a personal, non-exclusive, non-transferable and revocable right of use of the Service, strictly limited to private use defined by these T&Cs. Any reproduction, representation, modification, exploitation or use for commercial purposes of these elements, without prior written authorization from the Operator, is strictly prohibited.
Termination at the User's initiative: The User may request the closure of their account at any time by contacting support at support@apothem.fr. Termination takes effect after processing the request. It is up to the User to close their open positions themselves before requesting termination.
Termination at the initiative of apothem: apothem reserves the right to suspend or terminate access to the Service, with or without notice, in the event of:
In the event of termination for violation of the T&Cs, no refund is due to the User. Termination of the account does not affect the positions opened on the User's exchange, which remain under their sole responsibility.
apothem reserves the right to modify these T&Cs at any time, in particular to adapt to changes in the regulatory framework, the functionalities of the Service or industry practices.
In the event of a substantial modification of the T&Cs, the User will be notified by email to the address provided during registration, at least 15 days before the new conditions come into force.
Continued use of the Service after the entry into force of the new T&Cs constitutes acceptance of them. If the User does not accept the new conditions, he has the right to terminate his account free of charge before they come into force.
These T&Cs are subject to the French law, without prejudice to mandatory consumer protection provisions applicable in the User's country of residence within the European Union.
In the event of a dispute relating to the interpretation or execution of these T&Cs, the parties undertake to seek an amicable solution within thirty (30) days from notification of the dispute by the most diligent party.
In the absence of amicable settlement, any dispute will be subject to the exclusive jurisdiction of the competent courts within the jurisdiction of Lyon, notwithstanding plurality of defendants or warranty claim.

If a provision of these T&Cs is declared void, illegal or inapplicable by a competent court, the other provisions remain in force and continue to produce their effects to the fullest extent permitted by law.
These T&Cs, as well as the Confidentiality Policy and the Legal Notices, constitute the entire agreement between the User and apothem and replace any previous communication.
